In a personal injury case, like a car accident case or a slip and fall case, the defense council often requests that the plaintiff undergo an independent medical exam. A DME is supposed to be an objective assessment of your medical condition, including a determination of what, if any, treatment is required, whether you have a permanent impairment, the degree of the permanent impairment, and your ability to live your life in a productive manner going forward.
There is no difference. They are the same thing.
The doctor performing the exam will go through a history and physical with the plaintiff, and then do a physical exam, assessing range of motion, reflexes, and other measurements of function. The doctor then writes a report and submits it to both attorneys on their opinion based on the exam.
YES! These doctors are hired by the defense, so it is important to give your plaintiff representation within the exam. At Sunshine Nurse, we provide the plaintiff attorney the eyes and ears of a trained medical professional who can attest to the pain levels and lack of functioning of the plaintiff in a completely objective fashion.
